Free Fertility Law Q&A + Resources for Getting Legal Help in BC

Navigating Fertility on a Budget

Once you start thinking of having a family with assisted reproduction, one of the first things you may notice is the cost. Everything seems to have a price tag, from diagnostic testing to surrogacy contracts and counselling. Although the World Health Organization has deemed infertility to be a disease, it is still hard to get adequate public coverage in Canada for IVF and other fertility treatments.

Depending on your situation, you may also need the support of a Fertility Lawyer. Like most people, you may have never even heard of a “Fertility Lawyer” before, let alone know what one does or how they can help. Many legal issues require dedicated assistance from a fertility lawyer, but if you’re new to this area, there are ways to get started by accessing initial legal information without the full cost of private representation. In this blog, I outline some organizations that may provide you with summary legal advice or limited hours of legal help and share a recent webinar I did for the People’s Law School on “Fertility Law and Assisted Reproduction Law in British Columbia.

Free or Reduced Cost Legal Support

Fertility law sits at the intersection of family law, reproductive health, and sometimes other areas, like wills & estates, personal injury and health law. Lawyers in this field have dedicated significant time to mastering this area, which means it comes at a cost.

That said, there are options for accessing initial support to get you started. By speaking with a pro-bono clinic or organization, the lawyers there might be able to assist or refer you to a fertility lawyer who can help. I volunteer my time with Access Pro Bono BC and other local organizations to help make fertility law more accessible.

🤝 Access Pro Bono: Residents can get 30 minutes of legal advice at no cost if they meet their financial requirements but don’t qualify for Legal Aid. Find out here if you qualify.

⚖️ Legal Aid: Depending on your income and the type of issue you have, you may be eligible for related family law issues through Legal Aid in BC. Find out here if you qualify.

🏳️‍🌈 The QMUNITY Legal Clinic: This clinic is for 2SLGBTQIA+ individuals and families in B.C., offering free guidance on family, human rights, and other legal concerns. Contact them for more information.

📞 Family LawLINE: This is a free telephone legal advice service for people with low income experiencing a family law issue. Call their province-wide Call Centre during their office hours to see if you qualify.

📚 Everyone Legal Clinic: If you have a legal problem or need a service, you may consider contacting the Everyone Legal Clinic, which offers unbundled or limited scope assistance to those who qualify.
